| 1. |
How to Enquire/Book: |

| a. |
Fill in the enquiry form on the Contact Us page of www.peaking.com.au, email enquiries@peaking.com.au or phone 02 9905 5080 / 0409 11 49 44, outlining requirements. A quote will be sent by email or mail within 48 hours and is valid for 30 days from date of issue. |
| b. |
To confirm a booking, email bookings@peaking.com.au or phone 02 9905 5080 / 0409 11 49 44, advising quote acceptance and quoting reference number. Confirmation details and/or invoice will be sent by email, fax or mail within 48 hours. |
| c. |
To secure a booking, 50% deposit is required within 14 days of booking. 100% payment is due for bookings made within 5 days of departure. |
| d. |
Payment of deposit constitutes acceptance of the Terms and Conditions. |

| 2. |
Payment |
| |
| a. |
All prices-Australian Dollars; payment by direct debit, cheque or cash. Direct debit and cash only for bookings made within 5 working days of departure. |
| b. |
Final payments are due within 5 working days of departure. Peaking reserves the right to cancel all bookings where final payments are not received within this time. |

| 3. |
Cancellations/ Rescheduling and Refunds |

| a. |
Cancellations require notice by phone only. Voice messages are acceptable but texts are not. |
| b. |
Bookings cancelled or rescheduled |
| |
- More than 2 weeks prior to departure, receive a full refund or all monies paid.
- Less than 2 weeks and more than 72 hours of departure, receive a full refund of monies paid less 25% of the total cost.
- Within 72 - 24 hours of departure, forfeit the deposit.
- Within 24 hours of departure, no refund.

| c. |
The above conditions apply on a per person basis should final group numbers drop between confirmation of booking and departure. Minimum group numbers must not drop below those outlined in Peaking promotional materials. If they do, the above conditions apply. |
| d. |
If Peaking cancels due to bad weather or unforeseen circumstances, we will reschedule the experience for a mutually agreeable time and date no cost. |

| 4. |
Bad Weather |

| a. |
We operate in most conditions and some of our best adventures have occurred when the weather has been questionable (i.e. raining, cloudy, cold or no wind). In the interests of safety and maximum passenger enjoyment, we do not operate when sea and wind conditions are assessed as dangerous or breach the NSW Maritime survey operating limits. |
| b. |
If Peaking deems the conditions as satisfactory for the experience to proceed and you still decide to cancel due to weather, cancellation and rescheduling conditions as outlined above apply. |

| 5. |
Catering (Food and Drinks) |
| |
| Provision of food and drinks is on a Bring Your Own (BYO) basis unless negotiated at the time of booking and/or included as part of a package. Drinking water and ice are always provided but alcohol is strictly BYO (for persons over 18 years of age only). |

| 6. |
Responsible Service / Consumption of Alcohol |
| |
| Most Peaking experiences permit the consumption of alcohol for persons over 18 years of age on a BYO basis. While our goal is always to ensure maximum enjoyment, we adhere to the Responsible Service of Alcohol. All group members must consume alcohol responsibly, in moderation and respect the comfort and safety of others. They must be in a fit and coherent condition at all times to follow safety instructions and emergency procedures. Should our crew determine a safety risk exists in relation to an intoxicated person, we reserve the right to isolate the intoxicated person, and in extreme cases, call the Sydney Water police. No responsibility will be taken for group members removed from the vessel into the care of Sydney Water Police. |

Assumption of Risk |

| All group members must be aware that sailing/boating, as a Recreational Activity, can be perilous, accidents can happen and that they participate at their own risk. The physical risks and harm which may result in injury, death, property damage and economic loss include |
- Sudden vessel movements and jarring associated with traveling/sailing on a yacht and small ‘tender’ or getting on or off these vessel depending on water and weather conditions;
- greater than usual physical exertion placing people at an increased risk of personal injury, trauma or death;
- slipping, falling in overboard, entanglement in ropes or hitting of head on moving boom, any of which may cause injury or death, including death by drowning;
- exposure to the natural elements which can be unpredictable and potentially harmful or fatal including storm, wind, tide, current, heat, getting wet and flora and fauna including dangerous marine animals such as sharks;
- activities conducted at locations that are remote in time, distance and/or accessibility from medical treatment facility; and
- other risks of or incidental to the Recreational Activities or activities ancillary to the Recreational Activities.

| Peaking has mandatory emergency and safety procedures in place to minimise exposure to the above physical risks and harm. Each group member will be made aware of these prior to departure and will be required to agree that they are participating voluntarily, at their own risk, for the purposes of enjoyment, leisure and relaxation and will take care for the safety of themselves and others. |

| 8. |
Environment |
| |
| Peaking cares for the environment and adheres to all mandatory Safety and Environmental policies. All group members are expected behave in an environmentally sensitive manner at all times and work with Peaking crew to minimise the impact of their adventure on the natural environment. |

| 9. |
Privacy |
| |
| Peaking respects your privacy and we seek to protect your personal information at all times. We do not share, sell or trade any of the information collected by phone, email or via our web site, including email addresses, telephone numbers, postal addresses & names, with any companies or organizations. If you receive information from Peaking, it is because you have requested it, or a friend / colleague has requested it on your behalf. |
